Terms & Conditions for Online Payment
These Online Payment Terms and Conditions explain how payments made through the Cherubs Nurseries website are handled. Please read them before making a payment.
1. About these Terms
Our online payment service allows parents, carers and other authorised individuals to make payments to Cherubs Nurseries securely online. These Online Payment Terms and Conditions apply specifically to payments made through our website. They should be read alongside our Parent Terms and Conditions and Privacy Notice, where applicable.
Our Parent Terms and Conditions continue to govern your childcare arrangements with Cherubs Nurseries, including the fees and other amounts payable to us. Making a payment online does not replace or change those terms. By submitting a payment through our website, you confirm that you have read and agree to these Online Payment Terms and Conditions.
2. Making an Online Payment
You are responsible for making sure that the information you provide when making a payment is complete and accurate. This includes the payment amount and any information requested to help us identify and allocate your payment. Please check the information carefully before submitting your payment. Payments made through our website are processed securely by Worldpay, our payment processing partner. Your payment is subject to authorisation by your card issuer and successful processing by Worldpay.
3. Payment Confirmation
A payment is only treated as successfully made once the transaction has been authorised and we have received confirmation that the payment has been successfully processed. You should receive confirmation when your transaction has been completed.
If your payment is declined, interrupted or otherwise unsuccessful, you remain responsible for making payment by the applicable due date. If you are unsure whether a payment has been successful, please contact us before attempting the payment again to help avoid making a duplicate payment.
4. Allocating your Payment
We will use the information provided with your payment to allocate it to the appropriate account. Please make sure that any information requested to identify your account or child is entered accurately. If we cannot identify where a payment should be allocated, we may contact you for further information.
Making an online payment does not, by itself, confirm that an account has been settled in full. Any outstanding balance remains payable in accordance with our Parent Terms and Conditions.
5. Incorrect, Duplicate and Overpayments
If you believe that you have:
- Paid an incorrect amount;
- Made the same payment more than once;
- Made a payment against the wrong account;
- Provided incorrect information when making a payment
please contact us as soon as possible. We will investigate the payment and, where appropriate, correct the allocation or arrange a refund. Where an overpayment has been made, we may agree with you to apply the amount as a credit against future fees rather than issue a refund.
6. Refunds
Making a payment online does not create an additional or automatic right to a refund. Any entitlement to a refund will depend on the circumstances and, where relevant, our Parent Terms and Conditions and your statutory rights.
Where we agree that a refund is due in relation to an online payment, we will normally return the money using an appropriate payment method. Refunds may be subject to an Administration Charge, as per our Terms and Conditions. The time taken for a refund to appear in your account may depend on your bank, card issuer or payment provider. Nothing in these terms affects your statutory rights.
7. Payment Security
Online card payments are processed by Worldpay, our payment processing partner. When making a payment, your payment information is processed through Worldpay’s secure payment systems in accordance with the security requirements applicable to its payment services. You are responsible for taking reasonable steps to keep your own devices, account information and payment details secure.
If you believe that your card or payment information has been used without your permission, you should contact your bank or card issuer promptly.
8. Availability of the Payment Service
We aim to keep our online payment service available and working correctly, but we cannot guarantee that it will always be available or uninterrupted. The service may occasionally be unavailable because of maintenance, technical issues, problems affecting Worldpay or other circumstances outside our reasonable control.
If the online payment service is unavailable, this does not remove your responsibility to make any payment due to Cherubs Nurseries. Please contact us if you need help making payment by another available method.
9. Your Personal Information
When you make an online payment, we may collect and use personal information needed to identify you, allocate your payment, administer your account, maintain appropriate financial records and respond to any payment queries. Worldpay will also process information necessary to process and secure your payment.
Information that Cherubs Nurseries receives and processes is handled in accordance with our Privacy Notice. You can find more information about how we use personal information and your data protection rights in our Privacy Notice.
10. Our Responsibility to You
We will provide our online payment service with reasonable care and skill. We are not responsible for losses caused by circumstances outside our reasonable control, provided that we have taken reasonable steps expected of us in the circumstances. Nothing in these terms excludes or limits any responsibility that cannot lawfully be excluded or limited, or affects any rights you have under consumer law.
11. Changes to these Terms
We may update these Online Payment Terms and Conditions from time to time, for example to reflect changes to our payment service, our business, applicable law or regulatory requirements. The terms that apply to an online payment will be those displayed on our website when you make that payment. We show the date these terms were last updated at the bottom of this page.
12. Governing Law
These Online Payment Terms and Conditions are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you may also have rights under the laws that apply where you live.
13. Contact Us
If you have a question about an online payment, including an incorrect, duplicate or missing payment, please contact Cherubs Nurseries. When contacting us about a payment, please provide enough information for us to identify the transaction, such as your name, your child’s name where applicable, the nursery they attend, the payment date and the amount paid. For your security, please never send us your full card number or card security code by email.
